I. Website Terms and Conditions of Use

1. Terms

By accessing this Site, you are agreeing to be bound by these Website Terms and Conditions of Use (“Terms” hereinafter), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from using or accessing this Site.

By accessing this Site, you also acknowledge that you have been provided with an opportunity to inspect our Privacy Policy (“Policy” hereinafter), as outlined below. (See Section II of this current document for more details.)

2. Definitions

We” “our” and “us” each means Dream Inspire Believe, also referred to herein as “DIB”.

You” and “your” each means all of our past and present customers and visitors to our Internet websites located at either http://www.nocancernomore.com or http://www.dreaminspirebelive.org (the “Site” or “Sites,” respectively, hereinafter).

3. Use License

Permission is granted to temporarily download one copy of any materials (information or software) on DIB’s website for personal, noncommercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or further copy the materials beyond the single downloaded copy;
  • use the materials for any commercial purpose or for any public display (commercial or noncommercial);
  • attempt to decompile or reverse engineer any software contained on DIB’s website;

5. Limitations

IN NO EVENT SHALL DIB OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE MATERIALS ON DIB’S INTERNET SITE, EVEN IF DIB OR A DIB AUTHORIZED REPRESENTATIVE HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE. BECAUSE SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, OR LIMITATIONS OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THESE LIMITATIONS MAY NOT APPLY TO YOU.

DIB has not reviewed all of the sites linked to its Internet website and is not responsible for the contents of any such linked site. 9. Reservation of All Intellectual Property Rights

The materials contained in this Site are protected by applicable copyright law, trademark law, and may be protected by other forms of intellectual property protection as well. By using the Site you agree to be bound by the copyright, trademark, and other intellectual property laws of the United States. DIB expressly reserves for itself all protections of its own intellectual property to the maximum extent permissible by law.

10. Restrictions of Use on Third-Party Intellectual Property Assets

From time to time the Site may contain images, copyrights, logos, service marks, videos, and other intellectual property assets owned or at least partially owned by parties other than DIB (so-called “Third-Party IP Assets”). Nothing in these Terms should be construed as DIB’s permission for you to use any Third-Party IP Assets in any manner inconsistent with prevailing law or the very limited Use License as outlined above. Should you choose to use or misuse any Third-Party IP Assets appearing on the Site, you agree to indemnify and hold harmless DIB for any negative consequences to your actions.

11. Governing Law

Any claim relating to DIB’s website shall be governed by the laws of the State of New Jersey without regard to its conflict of law provisions.

II. Privacy Policy

Your privacy is very important to us. Accordingly, we have developed this Privacy Policy (“Policy”) in order for you to understand how we collect, use, communicate, and disclose and make use of personal information.

DIB believes in ideals of openness and transparency in the use of personally identifiably information that may impact on your privacy.

  • We will never sell, rent, or disclose any personal information collected to third parties unless required by law.
  • Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.
  • We will collect and use personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.
  • We will retain personal information only as long as necessary for the fulfillment of those purposes.
  • We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
  • We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification.
  • We will make readily available to customers information about our policies and practices relating to the management of personal information.

Children’s Privacy

We do not knowingly collect personal information from children under the age of 13. If we learn that we have personal information on a child under the age of 13, we will delete that information from our systems.

DIB encourages parents to go online with their kids. In fact, as a way to guarantee the Site’s compliance with laws governing the protection of children’s privacy, including but not limited to the Children’s Online Privacy Protection Act, DIB politely asks that no children under the age of 13 be permitted to use this Site without the appropriate supervision of an adult.

Here are a few tips for parents to help make a child’s online experience safer:

  • Teach kids never to give personal information, unless supervised by a parent or
    responsible adult. Includes name, address, phone, school, and so forth.
  • Know the sites your kids are visiting and which sites are appropriate.
  • Look for website privacy policies. Know how your child’s information is treated.

Log Files

Like many other website operators, DIB makes use of log files for the purpose of managing and optimizing the Site’s performance. Log files are a way for us to keep a statistical measure of who visits the Site, which pages these visitors spend time upon, and other web browsing traits of the visitors that are helpful for our objectives. The log files track, among other things, Internet protocol (IP) addresses, the type of browsers visitors are using, the Internet Service Provider (ISP) of a given visitor, the date/time stamp of a visitor, any referring or exit pages, and the number of clicks to analyze trends, administer the site, track user’s movement around the site, and gather demographic information. IP addresses and other such information are not linked to any information that is personally identifiable.

DIB does use cookies to store information about a visitor’s preferences, record user-specific information on which pages the user accesses or visits and customize web page content based on a visitor’s browser type or other information that the visitor sends via his or her browser.
